WE WILL HAVE NO LIABILITY FOR ANY MATTER DIRECTLY OR INDIRECTLY RELATING TO THE CREATION, MAINTENANCE, OR OPERATION OF THE INFLUENCER PAGE, AND YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD US, OUR AFFILIATES AND LICENSORS, AND OUR AND THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, AND REPRESENTATIVES, HARMLESS FROM AND AGAINST ALL CLAIMS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING ATTORNEYS’ FEES) RELATING TO ANY CONTENT WITHIN THE INFLUENCER PAGE PROVIDED BY YOU.
In June 1998, the FTC issued Online Privacy: A Report to Congress. The Report noted that while over 85 percent of all websites collected personal information from consumers, only 14 percent of the sites in the FTC's random sample of commercial websites provided any notice to consumers of the personal information they collect or how they use it. In May 2000, the FTC issued a follow-up report, Privacy Online: Fair Information Practices in the Electronic Marketplace. While the 2000 survey showed significant improvement in the percent of websites that post at least some privacy disclosures, only 20 percent of the random sample sites were found to have implemented four fair information practices: notice, choice, access and security. Even when the survey looked at the percentage of sites implementing the two critical practices of notice and choice, only 41 percent of the random sample provided such privacy disclosures. Many affiliate programs run with last-click attribution, where the affiliate receiving the last click before the sale gets 100% credit for the conversion. This is changing. With affiliate platforms providing new attribution models and reporting features, you are able to see a full-funnel, cross-channel view of how individual marketing tactics are working together. For example, you might see that a paid social campaign generated the first click, Affiliate X got click 2, and Affiliate Y got the last click. With this full picture, you can structure your affiliate commissions so that Affiliate X gets a percentage of the credit for the sale, even though they didn’t get the last click.
Because 2Checkout exclusively sells software and digital products, it is best suited for established influencers whose target audience is interested in buying products in this niche. But while you won’t find any physical products for sale, 2Checkout is probably the market leader in selling software of every type, including very specific use case items (like software that can convert Microsoft Word documents to PDF, for instance).
In effect, VigLink works as the middleman between a publisher (blogger) and merchants by scanning the publisher’s content and automatically creating links to publishers that are chosen “in real time” based on their payout/conversation rates. This makes VigLink a very hands-off affiliate program for publishers who prefer to focus on content instead of managing their affiliate links.
In addition to the foregoing Product Advertising Content and access to PA API, we may make available from time to time for use in connection with PA API sample source code and libraries, each of which will be made available to you under a separate license that accompanies each sample source code or library, as applicable. In connection with PA API, we may also make available specifications, user manuals, guides, supporting materials, and other information, regardless of format, describing the operational and functional capabilities, use limitations, technical and engineering requirements, and testing and performance criteria relevant to the proper use of PA API (collectively, “Specifications”). “Product Advertising Content,” as used in this License Agreement, specifically excludes any sample source code or libraries we make available to you under a separate license and any Specifications that we make available. It also specifically excludes any data, images, text, or other information or content relating to products offered on any site other than an Amazon Site.
Advertisers love affiliate marketing because it involves minimal risk. If a sufficient margin is built in as compensation for the affiliate, it becomes impossible to lose money. That’s because affiliates are generally only paid when a sale is completed (i.e., a lead is converted). Advertisers (or “merchants”) pay nothing for leads that don’t convert.
Reversal rates are generally in the low single digits; it’s standard for about 1% of transactions to be reversed. If you see offers with extremely high reversal rates, that could be a red flag. It doesn’t mean you should necessarily stay away, but it’s worth understanding why so many transactions are returned. For example, there’s something strange going on with this merchant:

You will not be eligible to receive any Standard Program Fees or Special Program Fees for any month if we determine that your Site is primarily promoting free Kindle eBooks and during that month (i) 20,000 or more free Kindle eBooks are ordered and downloaded during Sessions attributed to your Special Links, and (ii) at least 80% of all Kindle eBooks ordered and downloaded during Sessions attributed to your Special Links are free Kindle eBooks.
You must use both a unique public key/private key pair (each key pair, an “Account Identifier”) and an Associates tag parameter (which can be either the Associate ID issued to you under the Amazon Associates Program or a related Associates Program tracking ID) to identify your account and make calls to PA API. You will earn the Special Program Fee Rates described in this Section 4(b) in connection with “Trade-In Events” which occur when (1) a customer clicks through a Special Link on your Site to an Amazon Site and (2) during the resulting Session the customer adds a product to his or her trade-in shopping cart and then submits a trade-in request that Amazon accepts.
(c) Recommendations Page. We reserve all right, title and interest (including all intellectual property and proprietary rights) in and to, and you do not, by virtue of this Local Associates Policy or otherwise, acquire any ownership interest or rights in or to, the Recommendation Page, the Recommendation Page URL, or information and materials on the Recommendation Page. You will not take any action that conflicts with our rights in, or ownership of, the Recommendation Page. Amazon reserves all rights to determine the content, appearance, functionality, URL, and all other aspects of the Recommendation Page, including through the display of (i) advertising materials on the Recommendation Page, without compensation to any Local Associate, and (ii) disclosure (by text, link, icon, or otherwise) regarding your participation in this Local Associates Program.
The 900-Number Rule requires that ads for pay-per-call services disclose the cost of the call. Ads for services that promote sweepstakes or games of chance, provide information about a federal program (but are not sponsored by a federal agency), or target individuals under 18 years of age require additional disclosures. Ads for 900-numbers cannot be directed to children under 12 unless the ads deal with a bona fide education service, as defined by the Rule.
Keep your company’s business goal should also be top of mind. If your goal is attracting new customers, then maybe affiliates driving that type of traffic might be offered a better rate. And you may want to look at having different commission rates for different types of affiliate s- such as coupon affiliates, PPC affiliates, and super affiliates. Each of these groups has different strengths and will need to be addressed separately. You can also offer split commissions, whereby the commission is divided among multiple affiliates that participated in the process.
Websites and services based on Web 2.0 concepts—blogging and interactive online communities, for example—have impacted the affiliate marketing world as well. These platforms allow improved communication between merchants and affiliates. Web 2.0 platforms have also opened affiliate marketing channels to personal bloggers, writers, and independent website owners. Contextual ads allow publishers with lower levels of web traffic to place affiliate ads on websites.
